ACCEPTANCE OF TURNYOURPARTS.COM ADDITIONAL MEMBER TERMS Welcome to TurnYourParts.com . member services. By using these member services, you agree to these Additional Member Terms that supplement the TurnYourParts.com Terms of Service (TOS) located at (CLICK HERE ) which is incorporated by reference, and you further agree to comply with the TurnYourParts.com Member Guidelines located within our Policy Center. TurnYourParts.com reserves the right to update and change, from time to time, these Additional Terms and all documents incorporated by reference. You can always find the most recent version of this Additional Terms and the most recent version of the TurnYourParts.com Terms of Service at the URL indicated above.
TURNYOURPARTS.COM 2. DESCRIPTION OF SERVICE 2. a. TurnYourParts.com SubscriptionTurnYourParts.com allows paid subscribers to access the pricing and personal contact information listed in its classified ads section in order to get in touch with that advertiser for the sole purpose of inquiring or purchasing the item listed. The areas that a subscriber can view will depend on the level of your subscription. This subscription is not intended for the solicitation of anything else. 2. b. Types of Subscriptions (1) TURNYOURPARTS.COM Exclusive memberAn Exclusive membership allows paid subscribers to buy and sell within the entire TurnYourParts.com site, i.e. Garden Tractors (Pulling, & Antique) ATV’s, Go-Karting (Racing & Recreational), Motorcycles (Street or Dirt Bikes), snowmobiles. Additionally as a TurnYourParts.com Exclusive member you may also access the pricing and personal contact information in all classified ads. (2) TURNYOURPARTS.COM Premier memberA Premier membership allows paid subscribers to buy only. (3) TurnYourParts.com viewer allows paid subscribers to view only ads and thumbnails. No pricing or contact information will be available.More info can be found at Member details. 3. TURNYOURPARTS.COM ID AND TURNYOURPARTS.COM SUBSCRIPTION REQUIREMENTTo participate in our member services, you must have a valid TurnYourParts.com USERNAME and provide your credit card, billing and other information ("Registration Data"). If you do not have a TurnYourParts.com USERNAME or a TurnYourParts.com Account, you will be prompted to complete the registration process for them before you can pay for Member services. 4. PAYMENT TERMS 4. a. General TermsThe credit card that you provide as part of your Registration Data for TurnYourParts.com Account will automatically and immediately be billed. All currency references are in U.S. dollars. 4. b. Payment for Subscription PlansPayment occurs on a pre-pay basis and payment will be automatically renewed at the end of the term. Your billing term will be a monthly plan; you will be billed every month on the anniversary date of your Registration. On the sixth month, after five consecutive months you will not be billed. It is free; thereafter on the seventh month your billing cycle will resume. Please note: If you have received a free offer for a specific number of days, then you will not be charged for the first time until after your free time period has ended. Subsequent billing dates will be on the anniversary date of your first billing date. For example, if you purchase a monthly membership on October 15th and you get the first 30 days free, then you will not be charged at all until November 14th. (There are 31 days in October.) You would be charged again on December 14th and then again on January 14th, and so on until you decide to cancel. Upgrades from a TurnYourParts.comPremier membership to a TurnYourParts.comExclusive membership will be effective immediately. Your new subscription level will trigger a new billing period starting on the date of upgrade. Your credit card will reflect a charge for the full amount of the new subscription level. Downgrades from a TurnYourParts.comExclusive membership to a TurnYourParts.comPremier membership will be effective on the anniversary of your payment plan. Your new subscription level will trigger a new billing period starting on the date of downgrade. Your credit card will reflect a charge for the full amount of the new subscription level. Downgrades from a TurnYourParts.com Exclusive or a TurnYourParts.com Premier member to a TurnYourParts.com Viewer will take effect at the end of your monthly billing cycle 4. c. Cancellation for Subscription PlansPlease note, except as described at the bottom of these Additional Terms, and unless TurnYourParts.com gives notice to the contrary, payment for subscriptions are non-refundable. If you cancel your subscription before the end of the term for which you paid, your cancellation will take effect at the end of that term. For example, if you subscribe to a monthly plan, and you cancel after 15 days, you will still have the service until the end of the 30 days. 4. d. TerminationIf your credit card is invalid for any reason, your Member services account will be suspended or cancelled immediately and all the information contained within it deleted permanently. TurnYourParts.com accepts no liability for information that is deleted due to an invalid credit card. 4. e. Additional Terms(A) If by reason of death or disability you are unable to receive all the Services for which you contracted, you or your estate may elect to be relieved of the obligation to make payments for the Member services other than those received before death or the onset of disability, except as provided in paragraph 4.e (A) (3). (1) If you have prepaid any amount for the Member services, so much of the amount prepaid that is allocable to services that the buyer has not received shall be promptly refunded to you or your representative. (2) "Disability" means a condition which precludes you from physically using the Member services during the term of disability and the condition is verified in writing by a physician designated and remunerated by you. The written verification of the physician shall be presented to TurnYourParts.com . (3) If the physician determines that the duration of the disability will be less than six months, TurnYourParts.com may extend the term of these Additional Terms for a period of six months at no additional charge to you in lieu of cancellation. 5. TURNYOURPARTS.COM’S RESERVATION OF RIGHTSTurnYourParts.com expressly reserves the right to immediately modify, suspend or terminate Registrant's account and refuse current or future use of any TurnYourParts.com service, including all Services, if TurnYourParts.com , in its sole discretion believes Registrant has: (I) violated or tried to violate the rights of others; or (II) if we become aware of information indicating a safety concern for you, other TurnYourParts.com users, or the general public, or (III) acted inconsistently with the spirit or letter of the TOS, the Guidelines or these Additional Terms. 6. PRIVACYRegistration Data and certain other information about you are subject to our Privacy Policy. For more information, see our full privacy policy locate within our Policy Center. 7. LOCATION OF LAWSUIT The TurnYourParts.com Terms of Service, which apply to your Member services, provides that both you and TurnYourParts.com agree to submit to the personal and exclusive jurisdiction of the courts located within the county of Wayne, Pennsylvania. 8. CANCELLATION any cancellations will take effect at the end of your billing cycle anniversary (no refund will be issued for unused days).(A) To cancel your subscription by email, follow these instructions:(1) Send an email to customerservice@TurnYourParts.com with a “Cancellation Request” in the subject line: and(2) Including in the body of the email, your full name, TurnYourParts.com ID, and billing address used for your subscription. (B) You may also cancel your subscription by sending a notification by mail to: TURNYOURPARTS.COM. Must be post marked by the date of your billing cycle anniversary.
